Terms & Conditions

Terms and Conditions of Supply and Installation

Last updated: 20 October 2026

These Terms and Conditions apply to goods and services supplied by Quality Gas Solutions, trading as Eco NRG, ABN [insert ABN] (“Eco NRG”, “we”, “us” or “our”), to the customer identified in our quotation or project contract (“you” or “your”).

We provide air conditioning, heating, ventilation, hot water, gas and associated services in the Australian Capital Territory and New South Wales.

1. Your agreement with Eco NRG

Your agreement consists of the accepted quotation, scope of works, any applicable project contract, approved variations and these Terms and Conditions, where supplied to you before acceptance.

Acceptance may be recorded through our electronic quotation system or another agreed method, subject to any legal requirement for a signed contract.

Mandatory legal requirements apply first. Any applicable project contract takes precedence over these general terms. Expressly agreed special conditions and approved variations take precedence over the original quotation to the extent they change it.

Publishing these terms on our website does not, by itself, change an existing agreement.

2. Consumer rights and statutory protections

Our goods and services are subject to Australian Consumer Law and applicable ACT or NSW legislation.

Nothing in this agreement excludes, restricts or modifies any consumer guarantee, statutory warranty, cooling-off right or other right or remedy that cannot lawfully be excluded.

Manufacturer warranties and any additional warranties offered by Eco NRG operate alongside these rights.

3. Quotations and prices

Unless stated otherwise, quotations are valid for 30 days from their issue date. After that period, we may provide an updated quotation for your approval.

Prices include GST unless expressly identified otherwise. The quotation will show the total payable, including GST and known mandatory charges.

Any estimate or provisional allowance will be identified, together with the basis for calculating the final price.

A fixed quotation will not increase solely because our labour or supplier costs increase after acceptance. Changes to the agreed work must follow the variation process below.

4. Scope of works and exclusions

We will supply the equipment and complete the work described in the accepted quotation and approved variations.

Equipment will be new unless otherwise specified.

The quotation will identify exclusions and work to be completed by others. These may include painting, plastering, cabinetry, structural alterations, asbestos removal, switchboard upgrades or other specialist work.

An exclusion does not remove our responsibility for damage caused by our negligence or failure to exercise due care and skill.

5. Variations and additional work

If you request a change, or site conditions require a change to the agreed work, we will explain:

  • The proposed change and why it is required.
  • Any additional charge or credit, or the method for calculating it.
  • Any expected effect on completion.

Variations must be approved by both parties in writing before the changed work proceeds, including signatures where legally required.

If an immediate safety risk arises, we may stop work and take reasonable steps required by law to make the site safe. This does not authorise unrestricted additional work or charges.

6. Authority, approvals and access

You must have authority to engage us for the property.

Please advise us of any relevant landlord, strata, owners corporation, heritage or other approval requirements. The quotation or project contract will identify responsibility for obtaining approvals.

We remain responsible for licences, notifications and approvals that the law requires us to obtain.

You agree to provide reasonable, safe access to the work areas and advise us of known hazards, concealed services and access restrictions. Please keep children, pets and personal belongings safely clear of work areas.

We will seek instructions from you or your nominated representative. You are not automatically responsible for unauthorised or fraudulent instructions from another person.

7. Existing installations and concealed conditions

Our quotation is based on available information and conditions reasonably observable during assessment.

If we discover concealed damage, asbestos, unsafe wiring, defective plumbing, inadequate supports or other unexpected conditions, we will notify you and discuss the available options.

Additional work will follow the variation process. Where appropriate, you may arrange suitable work by another contractor.

We will not connect to or reuse equipment or services where doing so would be unsafe or unlawful.

We remain responsible for defects we cause and for assessing the suitability of existing components we agree to reuse within our scope.

8. Equipment locations and substitutions

Equipment, outlets, grilles, controllers, pipework and drainage will be installed in the agreed locations, subject to applicable safety, clearance, access and manufacturer requirements.

If an agreed location is unsuitable, we will discuss an alternative with you before proceeding.

We will not substitute a different equipment model or materially change the installation without your approval. Proposed substitutions will identify relevant differences in capacity, features, dimensions, warranty and price.

9. Workmanship and property protection

We will perform work with due care and skill, using appropriately licensed or qualified personnel where required.

Work will comply with applicable laws, required codes and standards, relevant approval conditions and manufacturer installation requirements.

We will take reasonable precautions to protect your property, appropriately seal and weatherproof installation penetrations, and remove installation waste included in our scope.

Necessary alterations and any agreed reinstatement will be identified in the scope. We remain responsible for damage caused by our negligence or breach of the agreement.

10. Scheduling and delays

We will advise the expected installation date or timeframe and perform work diligently within the agreed period or, where no period is agreed, within a reasonable time.

Weather, supply disruptions, unsafe conditions, access restrictions, approved variations and other events outside our reasonable control may affect scheduling.

We will notify you promptly of material delays, explain the expected impact and take reasonable steps to minimise disruption.

Any extension must reasonably reflect the actual effect of the delay. For substantial delays, we will discuss available options, including revised timing, agreed alternatives or termination where available under the agreement or law.

11. Deposits and progress payments

Any deposit and progress payment schedule will be stated in your quotation or project contract.

Deposits and progress claims will comply with applicable legal requirements. We will not request or accept payment before any legally required insurance or other payment precondition has been satisfied.

Progress claims will identify the completed stage or work and costs properly claimable under the agreement.

Payments already received will be credited against the final balance.

12. Invoices and payment

Unless otherwise agreed in writing, invoices are payable within seven calendar days of issue.

Final payment will be invoiced on completion of the agreed work, including commissioning and handover where applicable, subject to any agreed payment schedule.

If you dispute an invoice, please contact us promptly and identify the amount and reason in dispute. We will investigate and respond reasonably. Any undisputed amount remains payable by its due date.

Nothing in this clause limits statutory payment, dispute or consumer rights.

13. Overdue accounts

We will contact you about an overdue payment and provide a reasonable opportunity to resolve it.

Subject to applicable law and the project contract, we may suspend remaining work after written notice identifying the overdue undisputed amount, the proposed suspension date and how suspension can be avoided.

We will not leave the site unsafe.

We may seek reasonable external debt recovery costs actually incurred because of a payment default, but only to the extent permitted by law. We will not impose automatic administration charges or seek excessive or duplicated costs.

14. Cancellation and termination

Any statutory cooling-off or cancellation rights apply.

If you wish to cancel for a change of mind, please notify us as soon as possible.

Outside any applicable statutory cancellation process, we may seek payment for work properly completed and reasonable, substantiated losses directly caused by cancellation. We will take reasonable steps to minimise those losses and account for costs saved, supplier refunds, returnable equipment and equipment that can reasonably be used elsewhere.

There is no automatic forfeiture of the full deposit. We will provide an itemised calculation and refund any remaining balance.

Either party may terminate where permitted by law. For a breach capable of remedy, the other party will ordinarily provide written notice and a reasonable opportunity to remedy it before termination.

If we cannot complete the work for reasons unrelated to your breach, we will refund payments for goods and services not supplied, without limiting any other rights you may have.

15. Rebates, incentives and STCs

Any rebate, incentive or Small-scale Technology Certificate (STC) discount included in your quotation will be identified, together with known eligibility conditions and required assignments.

You agree to provide accurate information and reasonably assist with required declarations, access, photographs and supporting documents. We will explain known customer requirements before acceptance.

STC assignments and other scheme declarations will be recorded using the required separate documents.

Where eligibility remains unconfirmed, the quotation will explain whether a discount is provisional and identify the price payable if eligibility is not established before proceeding.

A rejected claim does not automatically make you responsible for the shortfall. We will explain the reason and proposed resolution.

You will not be responsible for a shortfall caused by our installation error, inaccurate advice, missed deadline or administrative failure, or that of a scheme provider engaged by us.

Any proposed adjustment arising from materially inaccurate customer information or failure to meet clearly disclosed customer obligations must be reasonable, agreed in writing and permitted by law.

16. Commissioning and handover

Where applicable, we will test and commission the installation, explain normal operation and provide relevant operating information and required compliance documentation.

Please notify us promptly of incomplete work or operating concerns so we can assess them.

Any outstanding items will be recorded with a reasonable arrangement for completion. Payment obligations remain subject to the project contract and applicable law.

17. Warranties and after-sales support

Manufacturer warranty information and details of any additional workmanship warranty will be supplied separately.

Australian Consumer Law guarantees and applicable statutory warranties operate independently of manufacturer warranties and may continue beyond a stated warranty period.

Please contact us about a fault in equipment or work we supplied. We will assess our responsibilities and will not require you to deal exclusively with a manufacturer where we have a legal obligation to assist.

We will not charge for a remedy we are legally required to provide. Any proposed charge for other inspection, servicing or repair work will be explained and agreed before chargeable work proceeds.

18. Maintenance and system performance

Please follow reasonable operating and maintenance instructions, including filter cleaning, servicing and keeping equipment clear.

Normal wear, misuse, inadequate maintenance or unrelated damage may affect coverage for a particular fault, but do not automatically remove rights relating to an unrelated defect.

We remain responsible for the suitability of equipment and design we recommend for the purpose you make known to us. Material sizing assumptions and operating limitations will be disclosed in the quotation.

Running costs and energy savings depend on factors including usage, tariffs, weather and building conditions. Figures provided are estimates unless expressly guaranteed.

19. Privacy and installation records

We collect information reasonably needed to quote, arrange, complete and support your work.

Relevant installation photographs and information may be used for job records, compliance, warranty and rebate purposes and shared with parties involved in those purposes.

We will obtain appropriate consent before using identifiable customer information or photographs for marketing.

Further details are available in our Privacy Policy and any scheme-specific notices supplied to you.

20. Complaints and disputes

Please contact us using the details below with your name, job number and a description of the issue.

We will investigate, respond within a reasonable time and work with you to resolve the concern.

Either party may seek assistance from the relevant ACT or NSW consumer protection agency, tribunal or court. This process does not prevent urgent action or limit statutory rights.

21. Governing law

For work performed in the Australian Capital Territory, the agreement is governed by ACT law and applicable Commonwealth law.

For work performed in New South Wales, the agreement is governed by NSW law and applicable Commonwealth law.

Nothing in these terms removes access to a court, tribunal or statutory protection available under applicable law.

22. Validity and updates

If a provision is invalid or unenforceable, the remaining provisions continue to operate to the extent legally possible.

The version supplied and agreed when your contract is accepted applies to that contract. Later website updates do not automatically change an existing agreement.
